Berkeley Springs man jailed after domestic incident

An anonymous caller alerted police to a female in distress at a residence on Debbie Terrace on Tuesday, November 26 around 11:30 p.m.

At the door of the residence, officers attempted to make contact with the occupants, yelling for them to exit, and using a PA system to call out the two occupants observed inside.

At one point, a female opened the door, looked back, and then locked the door, according to a criminal complaint filed in Morgan County Magistrate Court by West Virginia State Police Senior Trooper B.A. Meyers.

Police returned to the residence at 4:40 a.m. with a search warrant, and obtained a statement from the victim, who stated she was threatened, grabbed by the throat, and told she couldn’t leave, according to the criminal complaint.

Kenneth R. Foy, 68, was arrested and charged with obstructing an officer, possession of marijuana, unlawful restraint, and domestic battery. 

Foy admitted to putting the victim’s phone under a mattress, and possessing a small amount of marijuana, according to the criminal complaint.

He remains incarcerated at Eastern Regional Jail awaiting a hearing on the incident.
