Daniel James is new Prosecuting Attorney


Dan James Dan James Daniel M. James, Hampshire County’s Prosecuting Attorney, was chosen as the new Morgan County Prosecuting Attorney to begin on Friday, September 22.

At a special meeting, James was selected on Monday, September 11 by the Morgan County Commission as the appointed replacement for Debra MH McLaughlin.

McLaughlin is leaving her post as prosecutor to take the bench as a judge for the 23rd Judicial Circuit. She will be sworn in as a Circuit Court judge on Monday, September 18.

James was the Assistant Prosecuting Attorney for Morgan County from 2007-2012. He was elected as the Hampshire County Prosecuting Attorney in 2012 and was re-elected in 2016.

“It was a tough decision because we had excellent candidates to choose from,” said Morgan County Commissioner Bob Ford. “James was elected twice and has a great resume. You can’t ignore that,” he said.

Ford said the decision was unanimous.

James was one of three applicants who sought the prosecutor’s post.

The commissioners sought resumes for the prosecutor’s office from Tuesday, August 29 through Tuesday, September 5.

The commissioners had to appoint a person with the proper qualifications and a Republican affiliation to fill the top legal job in the county.

Commission President Joel Tuttle said his office posted the job opening on their website and social media page.

The Morgan County Commission held a closed door interview session for candidates on Thursday, September 7. Tuttle said county officials interviewed two candidates for the job.

James said Monday he was glad to have the support and confidence of the Morgan County Commission and that he was eager to come back to Morgan County. He said Morgan County is where he learned how to prosecute cases when he worked as the assistant prosecuting attorney with McLaughlin.

In his letter to the Commission, James wrote that he has prosecuted numerous felony offenses including several first degree murder trials. “I am proud to say that I have not lost a single jury trial while serving as the elected prosecutor. In large part, I attribute my success to the lessons I learned while working for Mrs. McLaughlin.”

James and his family have been living in Morgan County since 2007 and it is their permanent home.

James will have to run for election in November 2018 for Prosecuting Attorney in Morgan County.

The yearly Morgan County prosecuting attorney salary is $103,264, per W.Va. Code 7- 7-4 for Class III counties.
