FOR FORFEITURE

The object of this suit is to seek an
Order forfeiting the herein described
property pursuant to the West Virginia
Contraband Forfeiture Act (Chapter
60A, Article 7 of the West Virginia
Code, as amended).

TO: Any Claimant of a right to file a
claim to the herein described property
on or before March 19, 2018. Any such
claim must clearly state the identity of
the Claimant and an address where
legal process can be served upon said
Claimant.

The property seized and the subject
of this suit is described as follows:
Seven Hundred Ten dollars ($710.00);
One (1) iPhone 5 cell phone, pink (SN:
Unkwn); One (1) Samsung Galaxy Android cell phone, black (SN: Unkwn);
and One (1) Presario laptop, black
(SN: 2CE835SPR2).

The law enforcement agency responsible for the seizure is the Morgan
County Sheriff’s Department and
Berkeley Springs Police Department.
The seizure took place on November
17, 2017, in Morgan County, West Virginia. That certain property was located
at 110 South Green Street, Apartment
C, Berkeley Springs, WV 25411 in the
possession of James Alexander
Brooks and Amanda Powers.

That after the date for filing of said
claims, an Order of the Court directing
forfeiture of the seized property to the
State and vesting ownership of said
property shall be sought.

If you fail to file a claim, thereafter
an Order, upon proper hearing, may be
entered against you for the relief demanded in the Petiton.

A copy of said Petition can be obtained from the undersigned clerk at
his/her office.

covenants, conditions, reservations and restrictions set out in that certain deed
from Tuscarora Realty, Inc., et al., to Harley L. Heaton, et ux. dated the 26th day

page 179. THE ABOVE DESCRIBED REAL ESTATE is conveyed herein together
with the use of that certain 30-foot right-of-way conveyed to Bertil Malmstedt and

The referenced real estate will be conveyed with no covenants of warranty, and
subject to all covenants, restrictions, easements, rights of way and reservations
which may be a matter of record in the aforesaid Clerk’s Office or visible upon the
ground, all prior liens and encumbrances, including, without limitation, liens for
real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the
sale shall be responsible for paying the recording costs and also the tax on the
privilege of transferring real property (the cost of the tax stamp to be affixed to the
deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee
shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

order to modify the drainage area and control the added 39.7 acres in the southern
end of the permit area while removing the 39.7 acres from the western ridge of

The operation will discharge treated storm water into Warm Springs Run of Potomac River Drains and is located 2.7 miles, North of Berkeley Springs, in Bath
and Allen District(s) of Morgan County(ies), Longitude 78º 12’ 33” and Latitude
39º 39’ 39” (Coordinates from USGS Topographic Map).

The Department of Environmental Protection is seeking information on private
surface water intakes for human consumption located in the above listed receiving
streams and located down stream of this operation. Please provide your name,
phone number, mailing address, the name of the stream being with the intake,
and the physical location of the intake. This information needs to be submitted to
the address above.

An anti-degradation review has been conducted. Tier 1 protection is afforded
because effluent limitations ensure compliance with water quality criteria for all
designated uses. Where applicable, Tier 2 protection is also afforded because the
agency has made a determination that the discharge(s) will not cause significant
