Last Wednesday, January 17, a Morgan County jury convicted Joshua Lynn Fink of Delivery of a Controlled Substance Resulting in Death, stemming from the January 16, 2021 overdose death of Douglas Barnes.
Morgan County Prosecuting Attorney Dan James presented the case to the jury, with the trial beginning on Tuesday, January 16. Fink was represented by John McFarland and Juan Pittaluga.
James built his case on the testimony of six witnesses, including a forensic pathologist and toxicologist, and investigative evidence from police.
The investigation was a joint effort between Cpl. Luke Shambaugh of the Morgan County Sheriff’s Department and former Chief of Police for the Town of Bath, Tony Link.
Following the jury’s guilty verdict, Circuit Judge Debra M.H. McLaughlin ordered Fink to be held at the Eastern Regional Jail pending sentencing, which is scheduled for March 7.
