Grand Jury indicts 19 in January term

Members of the Morgan County Grand Jury returned 19 true bills when they met on Tuesday, January 8, indicting 19 individuals for a variety of felony crimes.

The accused will be arraigned in Morgan County Circuit Court on Monday, January 28 and will enter a plea of guilt or innocence to the charges.

Among those indicted was a Berkeley Springs man who faces 19 counts of sexual assault and abuse against a minor.

David B. Ball, 40, of Shanghai Road was indicted on six counts of second-degree sexual assault, six counts of sexual abuse by a custodian, six counts of incest and attempted second-degree sexual assault. Ball is accused of having sexual intercourse with a minor between December 2017 and February 2018.

Seth Beathard, 19, of Washington Courthouse, Ohio was indicted on a single count of first-degree sexual abuse. He is accused of making sexual contact with a child in Morgan County in August 2018.

Kevin R. Cain, 44, of Rio was indicted for possession of stolen vehicle in November 2018. He is accused of having a vehicle that was stolen out of Hardy County and bringing it into Morgan County.

Joshua E. Courtney, 28, of Berkeley Springs was indicted for possession of heroin with the intent to deliver the drug. Courtney is accused of carrying four packs of heroin and $1,021 in cash when police made contact with him in July of 2018.

David O. Cunningham, 54, of Winchester, Va. was indicted for possession of heroin with the intent to deliver the drug. He is accused of having the drug and trying to flee from police during the execution of an arrest warrant in Berkeley Springs in April 2017. Cunningham is accused of trying to hide a latex glove filled with two grams of heroin in a wooded area during the incident.

Ronald E. Davis Jr., 25, of Keyser was indicted for bringing stolen property into the state, fleeing with reckless disregard, reckless driving, destruction of property and failure to stop at a stop sign. Davis is accused of driving a vehicle he had allegedly stolen in the Cumberland area into Morgan County in December while fleeing from Maryland police, and striking a Sheriff’s Department cruiser in Berkeley Springs when he ran a stop sign.

Kenneth J. Fuller, 42, of Haysi, Va. was indicted for false pretenses. He is accused of lying about his source of income and writing bad checks to pay for a vehicle from Affordable Auto in October 2018.

Tyler A. Henry, 21, of McConnellsburg was indicted for financial exploitation of an elderly person and conspiracy with Chelsie N. Norris, 25, of McConnellsburg to defraud a blind 85-year-old Berkeley Springs man. The pair are accused of writing more than $12,000 worth of checks on the victim’s bank account for their own use between September and October of 2018.

Matthew C. Holland, 33, of Dundalk, Md. was indicted on two counts of forgery. He is accused of writing two checks to himself from the Cross Junction Liberty station in August of 2018 in the amount of $3,380.

Nathaniel P. Iacone, 35, of Winchester, Va. was indicted for entry of a building other than a dwelling and grand larceny. He is accused of breaking into Sonny’s Produce south of Berkeley Springs and stealing a white box truck in April of 2018.

Stephen A. Kuykendall, 34, of Berkeley Springs was indicted on charges of burglary, grand larceny and being a felon in possession of a firearm. Kuykendall is accused of breaking into a home and stealing more than $1,000 worth of items in August of 2018. He is also accused of having a firearm, which he isn’t allowed to possess because he is a convicted felon.

Cynthia L. Marineau, 41, of Berkeley Springs was indicted for DUI, third offense. She is accused of driving while under the influence of alcohol in August of 2018. She had two previous DUI convictions in California in 2009 and 2010.

Philip C. McAnulty, 60, of Berkeley Springs was indicted for malicious assault and brandishing. He is accused of Stabbing a man twice in a downtown Berkeley Springs apartment in September of 2018 following an argument. The victim suffered severe stab wounds.

William E. Pitner, 40, of Brunswick, Md. was indicted for DUI, third offense; driving while his license was revoked for DUI, third offense and having defective automobile equipment, all in July of 2018.

Kyle L. Smith, 31, of Hagerstown was indicted for financial exploitation of an elderly person and three counts of gross child neglect. Smith is accused of living in the home of an elderly Berkeley Springs woman and using her assets between May and August of 2018. He is also accused of leaving three children under the age of eight without supervision, in unsanitary conditions and without proper care or feeding.

April S. Spinks, #, of Berkeley Springs was indicted for embezzlement. She is accused of using more than $1,000 belonging to the New Hope Acres Property Owners Association for her own gain between January and October 2018 while she was treasurer of the association.

Shawn R. Vangosen, 40, of Great Cacapon was indicted for DUI causing serious bodily injury, two counts of DUI causing bodily injury, driving while his license was suspended, failure to stop at a stop sign and reckless driving. Vangosen is accused of causing a two-vehicle crash by driving through a stop sign at the intersection of Cold Run Valley Road and Cacapon Road in August 2018. The crash sent three people to the hospital. One person, the driver of the vehicle that Vangosen struck, was flown to INOVA Fairfax due to the seriousness of his injuries. Vangosen is accused of driving his vehicle recklessly and at high rates of speed while under the influence of heroin.
