The Morgan County Grand Jury indicted 11 individuals when they met last Tuesday, April 6 in their April term.
Indictments mean members of the Grand Jury determined there was enough evidence against an individual to proceed with a case in Morgan County Circuit Court. Those accused of the crimes will enter pleas of guilt or innocence during arraignments before Circuit Judge Debra McLaughlin on April 22.
Assault & battery
Joseph J. Prevallet, 34, of Pine Grove Road, Berkeley Springs was indicted for malicious assault and domestic battery. Prevallet is accused of attacking a relative living on family property, striking the victim in the face with a large wooden stake and his fists after the two argued about money and tools Prev
allet had borrowed. The case was investigated by Deputy J.C. Burkholder of the Morgan County Sheriff’s Department.
Timothy M. Sawchuck, 31, of Hedgesville was indicted for wanton endangerment involving a firearm, interfering with emergency communications and domestic assault. Sawchuck is accused of pointing a handgun at an individual during an argument that turned physical in February and keeping that individual from using communication methods to reach law enforcement. epartment.
Robert B. Twigg, 48, of Valley Road, Berkeley Springs was indicted for domestic battery, third offense and malicious assault. Twigg is accused of physically assaulting the victim who was attempting to leave the property. Twigg has prior convictions for domestic battery in May 2003 and October 2014. The case was investigated by Deputy Chris Roper of the Morgan County Sheriff’s Department.
Dustin B. Lindley, 19, of Pines Court, Berkeley Springs was indicted on six counts of third-degree sexual assault. He is accused of having sexual relations with a teenaged individual between August and December 2020. The case was investigated by Deputy Tony Link of the Morgan County Sheriff’s Department.
Drug dealing, charges
Daniel R. Anno, 26, of Valley Road, Berkeley Springs was indicted for possession with the intent to deliver a controlled substance – fentanyl and possession with the intent to deliver controlled substance—heroin. Anno is accused of having the drugs with the intent to deal them to others in November 2020. Police found the drugs during their response to a 911 call for a fight at a rental complex south of Berkeley Springs. The case was investigated by Cpl. Luke Shambaugh of the Morgan County Sheriff’s Department.
Mark A. Glad
den, 45, of Cooks Lane, Berkeley Springs was indicted for possession with intent to deliver a controlled substance – methamphetamine, driving while his license was revoked for DUI, improper use of registration and no motor vehicle inspection. Gladden is accused of committing the crimes in January of 2021. The case was investigated by Deputy Bradley Knotts of the Morgan County Sheriff’s Department.
Donald L. LeMaster Jr., 58, of Fairbee Road, Berkeley Springs was indicted for delivery of heroin, delivery of fentanyl, possession of methamphetamine with the intent to deliver the drug and possession of cocaine with the intent to deliver the drug. LeMaster is accused of selling heroin and fentanyl to confidential informants in December 2020 and January 2021. He is accused of possessing the methamphetamine and cocaine in January of this year. LeMaster was previously indicted in January for two other counts of drug delivery. The case was investigated by Capt. Tim Stapleton of the Morgan County Sheriff’s Department.
Thefts, stolen property
Victoria L. Berned, 28, of Flintstone, Md. was indicted for bringing stolen property in West Virginia. Berned is accused of bringing a stolen Chevrolet Express Van into the state in March from Maryland. The case was investigated by Deputy Tony Link of the Morgan County Sheriff’s Department.
Jacob D. Burrell, 32, of Martinsburg was indicted for grand larceny. Burrell is accused of stealing an outdoor furniture set, gas tank and oil from a residence on River Road in November 2020. During the investigation of property crime, police located a DMV temporary tag at the crime scene that was linked to Burrell’s vehicle used in the theft. The case was investigated by Cpl. Luke Shambaugh of the Morgan County Sheriff’s Department.
Tucker J. Price, 25, of Hancock, Md. was indicted for bringing stolen property into the state. He is accused of bringing a stolen riding mower into West Virginia in March. The case was investigated by Deputy Tony Link of the Morgan County Sheriff’s Department.
Timothy H. Shatzer, 43, of Clear Spring was indicted for fleeing with reckless disregard for the safety of others, passing in a no passing zone, speeding and driving on a suspended license. Shatzer is accused of committing the crimes in December 2020. The case was investigated by Cpl. Luke Shambaugh of the Morgan County Sheriff’s Department.
