Grand Jury indicts Zell on two murder counts
Last week, the Morgan County Grand Jury indicted 16 defendants on charges ranging from murder and concealment of a dead body to forgery. Half of the cases were indictments for drug possession and drug dealing offenses. The Grand Jury met on Tuesday, April 3, with Judge Andrew Frye presiding.
James T. Zell, 24, of Berkeley Springs was indicted on two counts of murder and one count of concealment of a deceased human body.
He is accused of killing his girlfriend, who was pregnant at the time of her death, and taking her dead body to a cabin in a remote location in Hampshire County in December 2011. The second murder count is for the unborn child.
Drug delivery & possession
Kimberlie Schrider, 22, of Sleepy View Lane, Berkeley Springs was indicted on five counts of possession of a controlled substance with the intent to deliver and DUI.
Jason L. McDonald, 35, of Householder Road, Hedgesville was indicted on two counts of possession with the intent to deliver, simple possession of a controlled substance, obstructing an officer and wearing masks.
Samantha Misdom, 23, of Unger Store Road, Berkeley Springs was indicted for possession of a controlled substance with the intent to deliver and simple possession.
Carrie B. Lowe, 28, was indicted on two counts of delivery of a controlled substance and one count of possession of a controlled substance with the intent to deliver.
Cindy L. Shifren, 51, of Berkeley Springs was indicted on two counts of possession of a controlled substance with the intent to deliver.
John P. Barrett, 33, of Kesecker Factory Road, Berkeley Springs was indicted on two counts of delivery of a controlled substance and three counts of possession of a controlled substance with the intent to deliver.
Heath E. Gingerich, 43, of the Eastern Regional Jail was indicted on two counts of possession of a controlled substance with the intent to deliver, two counts of failure to appear for court hearings and two counts of simple possession of a controlled substance.
Brian T. Hull, 30, of Cody Court, Martinsburg, was indicted on two counts of delivery of a controlled substance.
Theft, forgery
Betsy R. Colwell, 23, of Paw Paw was indicted for two counts of forgery and two counts of uttering (passing a bad check).
Dorothy M. Hayes, 42, of Paw Paw was indicted on two counts of fraud in connection with an access device, breaking and entering of an automobile and petit larceny.
DUI, driving offenses
Marty W. Powers, 42, of Golladay Road, Great Cacapon was indicted for fleeing under the influence, fleeing with reckless regard for safety, DUI second offense, reckless driving, speeding and failure to maintain control of his vehicle.
Samuel O. Barnes, 36, of Barnes Court, Berkeley Springs was indicted for driving while his license was revoked for a third offense DUI.
Robert W. Black, Jr., 61, of Painted Meadon Lane, Berkeley Springs was indicted for a third offense DUI and speeding.
Todd L. Lind, 36, of Red Hill Road, Martinsburg was indicted for a third offense DUI and driving left of center.
Anthony J. Spencer, 42, of Cumberland, Md. was indicted for being a felon in possession of a firearm and obstructing an officer.
Those indicted will be arraigned before Judge Andrew Frye on Monday, April 16. At that time, they will enter pleas, have trial dates scheduled and, if necessary, have bonds set.
