Trial dates and bond amounts setfor defendants indicted in January
Most of the 28 people indicted by the Morgan County Grand Jury on January 2 have now been arraigned before Circuit Judge Gina Groh. At their arraignments, they entered pleas and had trial dates and bond amounts set.
Trials set
Tex B. Simmons, 55, of Laurel Hill Lane, Berkeley Springs, pled not guilty to first degree sexual assault and sexual abuse. His bond was set at $25,000 and his trial scheduled for March 20.
Justin E. Moses, 24, of Dundalk, Md. and Michael A. Vaughan, 22, of Baltimore each pled innocent to malicious assault, battery, destruction of property and conspiring with the other to commit the crimes. Vaughan's bond was set at $10,000 and his trial for May 8. Moses' bond was set at $10,000 and his trial for June 5.
Robert B. Twigg. 34, who is presently in the Eastern Regional Jail, pled not guilty to two counts of burglary, two counts of grand larceny, destruction of property and possession of stolen property. His trial was set for March 20 and his bond at $5,000.
Raymond M. Unger, 30, of Martinsburg Road, Berkeley Springs, pled innocent to two counts of the delivery of a controlled substance. He was released on $10,000 personal recognizance bond until his trial, which is set for May 22.
Daniel H. Kerns, 21, of Spohrs Road, Berkeley Springs, pled not guilty to delivery of a controlled substance, possession with intent to deliver and conspiring to commit the crimes. His trial was set for May 22, and his bond placed at $10,000.
Kerns' alleged co-conspirator, James T. Ray, has not yet been arraigned. Ray, 28, of Swallow Place, Berkeley Springs, was said to be recuperating from an auto accident.
Shelley D. Clark, 44, of Rockwell Circle, Berkeley Springs, pled innocent to delivery of a controlled substance. She was released on $5,000 personal recognizance bond and her trial set for May 8.
Bradley J. Shaw, 35, of Sherrill Lane, Berkeley Springs, pled not guilty to possession of crack and possession of hydrocodone, both misdemeanor offenses. He is free on $2,500 bond, with trial scheduled for May 8.
Anna Blackwell pled innocent to possession of heroin, a misdemeanor. She was released on $2,500 personal recognizance bond until her trial on May 8.
Jeremy Kesecker, 36, of Providence Church Road, Hedgesville, pled not guilty to three felony counts of failing to appear for court hearings about a 2005 indictment for drug possession. His trial was set for March 30 and his bond at $50,000.
Virginia Weigle, 31, of Autumn Acres Road, Berkeley Springs, pled not guilty to 14 counts of forgery, 14 counts of uttering (passing a forged check), two counts of petit larceny and participating in fraudulent schemes. Weigle was released on $25,000 personal recognizance bond and her trial was set for June 5.
Vernon L. Kerns, Jr., 24, of Susan Terrace, Berkeley Springs, pled innocent to three counts of fraudulently using a credit card. His trial was scheduled for May 22 and his bond placed at $2,500.
Diane McCormick, 49, and Henry J. McCormick, 54, of Thornwood Drive, Berkeley Springs, each pled not guilty to three counts of child neglect and three counts of child abuse. Each was released on $20,000 personal recognizance bond, with trial set for June 5.
A third defendant in the same case — Andrew S. McCormick, 24, also of Thornwood Drive – is expected to be arraigned soon. He, too, is free on $20,000 personal recognizance bond.
Greta Fox, 38, of South Washington Street, Berkeley Springs, pled innocent to two counts of child neglect. She was released on $5,000 personal recognizance bond and her trial was set for May 8.
David Kendall of Honeycrest Drive, Berkeley Springs, pled not guilty to the same charges as Fox. He was released on $10,000 personal recognizance bond until his June 5 trial.
Brandon R. Neely, 20, of Cold Run Valley Road, Berkeley Springs, pled innocent to domestic battery, a misdemeanor. His trial was set for May 22 and his bond was placed at $10,000.
Gregory J. Glaser, 24, of Cabins Lane, Berkeley Springs, pled not guilty to a felony third offense of driving under the influence of alcoholic beverages and to four misdemeanor offenses — driving while his license was revoked for DUI, reckless driving, speeding and not using a seatbelt. Glaser was released on $5,000 personal recognizance bond and his trial was scheduled for May 8.
Daren L. Cain, 37, of Hedgesville pled innocent to a felony third offense of driving while his license was revoked and to speeding, a misdemeanor. His trial was set for May 8 and his bond at $10,000.
Lonnie D. Hobday, 29, of Berkeley Springs pled not guilty to two counts of failing to pay child support, totaling more than $22,000. Hobday was released on $5,000 personal recognizance bond and his trial was scheduled for May 8.
Michael T. MacCumbee, 39, of Netherfield Court, Winchester, Va. pled innocent to failing to pay child support between April, 1997 and December, 2006. MacCumbee was released on $2,500 personal recognizance bond and his trial was set for March 20.
Warrants
Judge Groh issued warrants for two people who have not showed up for arraignments. They were:
—Titus Myers, 37, of Aurora, Indiana, who was indicted for failing to pay child support.
—Christopher Whitley, 35, of Concord, North Carolina, who was indicted for three felony counts of failing to appear for court hearings about a 2004 indictment for failing to pay child support.
Three others are expected to be arraigned in the weeks ahead:
—Bobby A. Boone, 57, of Fort Collier Road, Winchester, who was indicted for failing to pay child support, Boone was said to be incarcerated in Virginia.
—Joel M. Largent, 35, of Paw Paw, who was indicted for delivery of a controlled substance. Largent was not in court on February 5, but was given another chance to appear.
—Sherry L. Reed, 30, of Berkeley Springs, who was indicted for five counts of forgery, five counts of uttering, petit larceny and participating in fraudulent schemes. Reed was extradited from Hampshire County after a warrant was issued for her arrest, according to court documents.
